During the COVID-19 pandemic, many advocacy groups and individuals criticized governments on social media for doing either too much or too little to mitigate the pandemic. In this article, we review advocacy for COVID-19 elimination or “zero-covid” on the social media platform X (Twitter). We present a thematic analysis of tweets by 20 influential co-signatories of the World Health Network letter on ten themes, covering six topics of science and mitigation (zero-covid, epidemiological data on variants, long-term post-acute sequelae (Long COVID), (...) vaccines, schools and children, views on monkeypox/Mpox) and four advocacy methods (personal advice and promoting remedies, use of anecdotes, criticism of other scientists, and of authorities). The advocacy, although timely and informative, often appealed to emotions and values using anecdotes and strong criticism of authorities and other scientists. Many tweets received hundreds or thousands of likes. Risks were emphasized about children’s vulnerability, Long COVID, variant severity, and Mpox, and via comparisons with human immunodeficiency viruses (HIV). Far-reaching policies and promotion of remedies were advocated without systematic evidence review, or sometimes, core field expertise. We identified potential conflicts of interest connected to private companies. Our study documents a need for public health debates to be less polarizing and judgmental, and more factual. In order to protect public trust in science during a crisis, we suggest the development of mechanisms to ensure ethical guidelines for engagement in “science-based” advocacy, and consideration of cost–benefit analysis of recommendations for public health decision-making. Research Objective: This study focuses on ADs in the Netherlands and introduces a cross-cultural perspective by comparing it with other countries. Methods: A questionnaire was sent to a panel comprising 1621 people representative of the Dutch population. The response was 86%. Results: 95% of the respondents didn't have an AD, and 24% of these were not familiar with the idea of drawing up an AD. Most of those familiar with ADs knew about the Advanced Euthanasia Directive (AED, 64%). Both low (...) education and the presence of a religious conviction that plays an important role in one's life increase the chance of not wanting to draw up an AD. Also not having experienced a request for euthanasia from someone else, and the inconceivability of asking for euthanasia yourself, increase the chance of not wanting to draw up an AD. Discussion: This study shows that the subjects of palliative care and end-of-life-decision-making were very much dominated by the issue of euthanasia in the Netherlands. The AED was the best known AD; and factors that can be linked to euthanasia play an important role in whether or not people choose to draw up an AD. This differentiates the Netherlands from other countries and, when it comes to ADs, the global differences between countries and cultures are still so large that the highest possible goals, at this moment in time, are observing and possibly learning from other cultural settings. Pediatric oncology has a strong research culture. Most pediatric oncologists are investigators, involved in clinical care as well as research. As a result, a remarkable proportion of children with cancer enrolls in a trial during treatment. This paper discusses the ethical consequences of the unprecedented integration of research and care in pediatric oncology from the perspective of parents and physicians. An empirical ethical approach, combining (1) a narrative review of (primarily) qualitative studies on parents' and physicians' experiences of the pediatric (...) oncology research practice, and (2) comparison of these experiences with existing theoretical ethical concepts about (pediatric) research. The use of empirical evidence enriches these concepts by taking into account the peculiarities that ethical challenges pose in practice. Analysis of the 22 studies reviewed revealed that the integration of research and care has consequences for the informed consent process, the promotion of the child's best interests, and the role of the physician (doctor vs. scientist). True consent to research is difficult to achieve due to the complexity of research protocols, emotional stress and parents' dependency on their child's physician. Parents' role is to promote their child's best interests, also when they are asked to consider enrolling their child in a trial. Parents are almost never in equipoise on trial participation, which leaves them with the agonizing situation of wanting to do what is best for their child, while being fearful of making the wrong decision. Furthermore, a therapeutic misconception endangers correct assessment of participation, making parents inaccurately attribute therapeutic intent to research procedures. Physicians prefer the perspective of a therapist over a researcher. Consequently they may truly believe that in the research setting they promote the child's best interests, which maintains the existence of a therapeutic misconception between them and parents. Due to the integration of research and care, their different ethical perspectives become intertwined in the daily practice of pediatric oncology. Increasing awareness of what this means for the communication between parents and physicians is essential. Future research should focus on efforts that overcome the problems that the synchronicity of research and care evokes. (shrink)

In this paper however, the object is to examine the ‘Critique of Judgment’, especially the concepts of the Beautiful and the Sublime, in relation to the Kantian version of the Enlightenment. The main theses in the paper are as following: That Beauty can provide us with the sensuous experience of the possibility of the moral law and that the Sublime can provide us with the (...) sensuous experience of the possibility that we as rational beings can effectuate the actual existence of the moral law. Background: The 21-item Nurses’ Moral Courage Scale was developed and validated in 2018 in Finland with the purpose of measuring moral courage among nurses. Objectives: The objective of this study was to make a Dutch translation of the Nurses’ Moral Courage Scale to describe the level of nurses’ self-assessed moral courage and associated socio-demographic factors in Flanders, Belgium. Research design: A forward–backward translation method was applied to translate the English Nurses’ Moral Courage Scale to Dutch, and a pilot study was (...) conducted to improve readability and understandability. A non-experimental, descriptive cross-sectional exploratory design was used to conduct a survey. Descriptive analysis was used. Participants: The data were collected from a convenience sample of 559 nurses from two hospitals in Flanders. Ethical considerations: Ethical approval was obtained from the university ethics committee, permission to conduct the study was obtained from the participating hospitals. Participants received a guide letter and gave their informed consent. Findings: The readability and understandability of the Dutch Nurses’ Moral Courage Scale were positively evaluated, and the scale revealed a good level of internal consistency for the total scale (α =.914) and all subscales. Nurses’ mean score of the 21-item Nurses’ Moral Courage Scale was 3.77 (standard deviation = 0.537). The total Nurses’ Moral Courage Scale score was associated with age (p <.001), experience (p <.001), professional function (p =.002), level of education (p =.002) and personal interest (p <.001). Discussion and Conclusion: The Nurses’ Moral Courage Scale was successfully translated to Dutch. The Flemish nurses perceived themselves as morally courageous, especially when they were in a direct interpersonal relationship with their patients. Acting courageously in ethical dilemmas that involved other actors or organizations appeared to be more challenging. The results strongly suggest the important role of education and ethical leadership in developing and supporting this essential virtue in nursing practice. (shrink)

The paper presents a phenomenology of the hand in four declinations: the touching, the grasping, the working and the throwing hands. This selective sequence expresses not only the disposition but also a hypothesis. To be disclosed is a distance already in the intimate doings and a proximity still in the far-reaching operations of the hands. The claim is that this intimate alienness and distant proximity makes the human hands technical and associates the human being originally with technology. Consequently, legitimate allocation of healthcare has seemed almost unattainable in contemporary pluralistic societies. The problem is that citizens do not agree on any (...) single principle governing priorities among groups of patients. The Accountability for Reasonableness framework suggests an ingenious solution to this problem of moral disagreement. Rather than advocating any substantive distributive principle, its advocates propose a feasible set of conditions, which, if met by decision makers at the institutional level, provide, so it is promised, legitimate decisions. While we agree that A4R represents an important contribution to the priority-setting debate, we challenge the framework in two respects. First, we argue that A4R, and more specifically the relevance condition of A4R, does not enable healthcare institutions to generally distinguish between relevant and irrelevant reasons for priority-setting. Second, we criticize Daniels’ and Sabin's argument that A4R and deliberative democracy constitute necessary and sufficient conditions of a feasible procedure for setting legitimate limits within healthcare. CONCLUSIONThis brief survey of the assessment of the Resurrection of Jesus in contemporary Catholic Christology indicates the presence of widely varying views on the nature of the Resurrection, on the manner of its revelation, and on the role attributed to it in the overall structure of theology. While it is improbable that a unified consensus will be achieved in the near future, if ever, a few concluding remarks may serve to direct attention to some central issues which underlie the variations.First, (...) more explicit attention could profitably be directed to the correlation of the understanding of the nature of the Resurrection with the theological function attributed to it. It is not at all certain that all opinions on the nature of the Resurrection are compatible with all of its theoretically possible theological functions. Is it, for example, consistent to understand the Resurrection as inseparable from Jesus' death, while assessing the Crucifixion in negative terms and attributing to the Resurrection the function of legitimating the claims of the historical Jesus ? Authors such as Kiing and Kasper seem to have drawn eclectically on disparate sources without having adverted sufficiently to the problems involved in a synthesis of different conceptions. Thus their positions on the function of the Resurrection in Christology are reminiscent of Wolfhart Pannenberg, 74 while their descriptions of the connection of death and resurrection draw heavily and explicitly on Karl Rahner. It would seem, however, that Rahner's conception of the nature of the Resurrection is incompatible with Pannenberg's christological argumentation. 75 At the very least, more expb'cit discussion of this issue would help to dispel the appearance of inconsistencies in the viewpoints of some authors.Secondly, it would seem that the central disputed issue with regard to the theological function of the Resurrection is the question of the sufficiency of the historical Jesus as basis and criterion of Christology. This question is also central to current Protestant Christology, as the opposing views of Pannenberg and Gerhard Ebeling76 clearly indicate. Its discussion is unfortunately often impeded by the use of identical terminology for different referents: some who assert the sufficiency of the historical Jesus and most of those who deny it are inclined to abstract from Jesus' death when they refer to the historical Jesus, while others not only include the Crucifixion but even attribute to it a very prominent position in their understanding of Jesus' life. Now the question of the sufficiency of the historical Jesus in abstraction from his death is quite different from that of his sufficiency when his death is included. The charge that theologies which assert that the historical Jesus is sufficient basis and criterion of Christology are inevitably reductionist is quite telling when raised against those whose conception of the historical Jesus abstracts from his crucifixion, but it is not necessarily valid when directed against those who do not do this. An uncritical presumption of Pannenberg's problematic distinction between Jesus' actions and his double fate of crucifixion and resurrection 77 may be at the root of many problems here. In view of the fact that Jesus' death was the consequence of his public activity, assessment of his public life in abstraction from that death is scarcely possible. The views which assert the sufficiency of the historical Jesus while incorporating the Crucifixion into their understanding of the historical Jesus require and deserve more careful examination. They possess the major advantage that in such approaches Christology's basis and criterion is accessible historically, while other proposed criteria, such as Küng's ‘biblical Christ’ or Kasper's ‘earthly Jesus and the risen and exalted Christ’ presuppose the resolution of what Rahner rightly considers the first and most basic christological question, the legitimacy of the step from the historical Jesus to the christological kerygma of the early Church .This leads immediately to a final remark: The key to discussion of the Resurrection is the theological interpretation of Jesus' death. Although critical assessment of the theory of satisfaction and of the category of sacrifice pertain to this question, 78 the matter is far more complex than these aspects alone. Further systematic study, which could profitably draw on the renewed exegetical examination of the various interpretations to be found in the New Testament, 79 is urgently needed. Avoidance of isolation of Jesus' death from his public life is one major precondition for the development of a valid interpretation of it. 80 While neither a survey of existing opinions nor a constructive proposal can be offered here, it might be suggested, without advocating false glorification of the Crucifixion, 81 that a theology which evaluates Jesus' death in exclusively negative terms will ultimately prove unable to provide a well‐grounded positive christological assessment of his life. Kasper's Theology and Church (pp. 94-108; Kasper says simply, "Rahner's characterization of neo-Chalcedonianism is historicaly inaccurate," p. 214, note 18). As it is, Ols's treatment reminds us that Rahner's own writings, which overlooked the later Councils of Constantinople, presume that Chalcedon had been the end of a development in Christology; this (...) inaccurate presumption has dominated too much of the writing which has followed Rahner's essay. Ols returns to this problem of " latent monophysitism " in some classical christologies in the final chapters of his work (VIII-XI). With a careful examination of the christology of Aquinas, the author skillfully demonstrates the rich development of Christ's true humanity that is possible within the classical approach; he deals specifically with the topics of Christ's knowledge, his sinlessness, and the concept of person. (It is interesting to note that, like Rahner and others before and after, Ols thinks that the word "person" is not particularly felicitous and would prefer simply the word hypostasis or subsistence [p. 187]. His wish is likely to have no more success than previous suggestions in this regard.) Although limited in its intent, this hook is rich in many ways. Ols's knowledge of St. Thomas is deep, and he uses that knowledge well. His critique of Rahner and Schilleheeckx may he forceful in its negative assertions, hut I believe it is accurate in pointing out the philosophical idealism that underlies much of their christological writings. This idealism is too often overlooked and needs the corrective of what we might call "Mediterranean realism." Although his criticism may he incisive, it is never unfair or strident, and he is aware of the positive insights that these men have contributed to our continuing reflections on the Lord. By intent, Ols's work is essentially one of evaluation and criticism. Nevertheless, the chapters that reflect on (and develop) Aquinas's teaching and give a positive presentation of the real human· ity of the Lord lead one to hope that the author will follow this study with a fully elaborated christology. Several good hooks on Kant's political philosophy have appeared in the past decade, hut the literature on Kant's political philosophy is still both slimmer and weaker than on any other aspect of his thought. 536 BOOK REVIEWS Though we still await a definitive study of the topic, this book goes a long way toward filling some important gaps. Even the best books on Kant's political philosophy tend to treat only the broad outlines of Kant's position, shying away from detailed exposition of Kant's theories of individual right and external possession and of the political theory based on them. Mulholland's is not only the most detailed but also the most persuasive account of these matters which has yet been presented in English. The book's first four chapters attempt to lay the foundations for Kant's political philosophy through a general discussion of his ethical theory. The main function of these (somewhat overlong) introductory chapters is to argue for a tension between the law of nature formula (which Mulholland prefers as a guide to Kant's theory of right) and the formula of humanity as end in itself. According to Mulholland, the law of nature formula leads to a theory of rights and political obliga· tion which places Kant in the natural law tradition, whereas the formula of humanity commits him to what Mulholland calls the " deed principle ": that acquired rights can come about only through a deed on the part of those having the duties corresponding to the rights through which these duties have been assumed. Mulholland argues that if we take the deed principle strictly, then we must base political obligation on consent and thus on a social contract. The burden of Mulholland's argument throughout the book is that Kant cannot sustain the deed principle, and it is... (shrink)

The Catholic Universtiy of America Washington, D.C. MARK D. NAPACK Hans Urs von Balthasar. His Life and Work. Edited by DAVID L. SCHINDLER. San Francisco: Communio Books/Ignatius Press, 1991. Pp. 305. This is an important contribution to English-language scholarship on the Swiss theologian Hans Urs von Balthasar. As such it marks a nice complement to the volume edited by John Riches, The Analogy of Beauty: The Theology of Hans Urs von Balthasar (Edinburgh: T. & T. Clark, 1986). Schindler's volume is a slightly edited translation of Hans Urs von Balthasar: Gestalt und Werke, edited by Karl Lehmann and Walter Kasper (Cologne: Communio, 1989). Most of the articles appeared in one or more of the many editions of Communio International Catholic Review, the periodical founded by Balthasar. The richness of the volume lies not only in the quality of individual selections but in the range of material that is covered. Many areas of Balthasar's life and work have remained little known, especially in the English-speaking world, until the appearance of this volume. The pur- 690 BOOK REVIEWS pose of the book, according to Schindler's preface, is "to help display [Balthasar's] vision and the character and range of his service to the Church and to culture" (p. xiii). There are several essays in the volume which shed new light on Balthasar's life, as well as on his philosophical position. Peter Henrici's lengthy biographical sketch is the most complete such contribution available until now, even though he calls it "preliminary and inadequate " (p. 7). It is extremely useful, in conjunction with Balthasar's own autobiographical statements, to situate the written work in the context of a large mission in the Church. It is also helpful in clarifying the relationship between Balthasar and the Jesuit order: his entry into the Society of Jesus, his studies, his departure from the Jesuits, and the attempted reconciliation with them shortly before his death. The extent of his health problems, also, only underlines the value of his literary production. Many details concerning the meeting with Adrienne von Speyr and the founding of the secular institute ]ohannesgemeinschaft are also provided. Throughout these activities and the writings that surround them, "the issue is the Church in the world, not a radiating of the Church's holiness into the profane world, but the leavening of the world from within in order to make visible God's glory which still shines in this world" (p. 24). Henrici has another essay in the collection on the philosophy of Balthasar. This is a little explored area of Balthasar's writings and Henrici's contribution is especially valuable. By clarifying Balthasar's position in relation to key figures in the history of philosophy, it provides many significant hints to facilitate the integration of Balthasar's theology within the academic milieu. Hempel's Dilemma is the claim that physicalism is an ill-formed thesis because it can offer no account of the physics that it refers to: current physics will be discarded in the future, and we don't yet know the nature of future physics. This article confronts the first horn of the dilemma, and argues that our knowledge of current physics is sufficient for offering a physicalist ontology of the mind. In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS Unbaptized God. The Basic Flaw in Ecumenical Theology. By ROBERT W. JENSON. Minneapolis: Fortress Press, 1992. Pp. v + 152. $16.95 (paper). The thesis of this potentially revolutionary book is nicely summarized in its title: the basic flaw in ecumenical theology is the unbaptized-that is, insufficiently trinitarian-God of Christians East and West, Protestant and Catholic. The book is revolutionary because it proposes a new way of reading (...) the logic of a myriad of ecumenical dialogues over the last quarter century; as a result, ecumenical theology and praotice for which God is among the " settled " issues ought be appropriately chastised by this book. But I think that Unbaptized God is only "potentially " revolutionary because I think Jenson leaves two crucial questions unanswered. Jenson's daring argument is made with rare clarity and compactness. Consider the argument in three stages. First, in an introduction, Jenson describes " the frustration of dialogue." He does not mean the frustration created by the meager knowledge or acceptance of the results of ecumenical dialogues on the popular level-or the reception without action of these results by Church officials (p. 2). He focuses on " a third mode of frustration ": a dialogue will proceed toward a " convergence," not without "tolerable divergence "; but the initially tolerable divergence eventually yields " a newly virulent division." The process is seemingly "circular" (p. 3). "No set of convergences ever seems to be enough, once the separations are there " (p. 4). Why? And what can be done about this? Second, Jenson illustrates the frustration and starts showing the way beyond it in several different ways. He describes the dialogues in the first two parts of the book. In Part One, Jenson takes up "The Early Ecumenical Convergences " on issues central to the sixteenth century reformations, Ca.tholic and Protestant: Justification (ch. 1), Real Presence (ch. 2), and Eucharistic Sacrifice (ch. 3). Part Two takes up Churchly Office (ch. 4), Episcopacy (ch. 5), Roman Primacy (ch. 6), and The Church's Mediation (ch. 7). The distinctions between the issues of Part One and Part Two seem to be both historical and logical. Historically, the issues of Part Two are what Walter Kasper called the surprising "displacement of the problematic" (p. 44) from issues 677 678 BOOK REVIEWS considered central by Trent and the Reformers (especially justification and the eucharist) to issues that emerged after the Reformation (especially ecclesiology). Logically, the distinction between Part One and Part Two is the distinction between the traditional matters of controversy (Part One) and what are claimed to be differences "hidden at some conceptual level deeper than that occupied by the traditional matters of controversy" (Part Two) (p. 7). I will not rehearse Jenson's splendid summaries of the many dialogues in English, French, and German (although the book ought be recommended on these grounds alone). The unofficial Groupe des Dombes is regularly regarded as the most ecumenically insightful, and the Dominican J. M. R. Tillard plays a particularly crucial role among Roman Catholic theologians. It is enough to say that Jenson successfully shows how each dialogue can be read as an instance of the frustration he initially mentioned: a " convergence " occurs on each topic which later turns into a " divergence " which later is converted into a " convergence " and so forth. By the end (ch. 7), everything seems to circle back to the doctrine of justification (ch. 1). But the appearances, Jenson argues, are deceiving. "The pattern of the dialogue's history proves to be more like a spiral than a circle on a plane" (p. 103). Thus, besides describing the dialogues, Jenson must also prove that the dialogues exhibit a non-circular movement. One of the fascinating features of Jenson's argument at this stage is that he does this in a slightly different way in each of the first seven chapters. For example, he sometimes clears away "illusory dissensus" (p. 22). He sometimes concludes that "the Catholic side is right." Indeed, the Catholic side seems right on most crucial issues-on convictions about the temporal constitution of persons that constitute the background for arguments over Real Presence (p. 32); on the "new" Catholic theology of eucharistic sacrifice (p. 41) ; on episcopal succession (p. 74... The epidemic of COVID-19 appears to be reshaping the world, separating before and after, present and past. Its perceived novelty raises the question of what role the past might play in the present epidemic and in responses to it. Taking the view that the past has not passed, but is present in is material and immaterial remains, and continuously emerging from these, we argue that it should not be studied as closed narration but through the array of its traces, which (...) constitute the texture of the present. To that end, and building on long-term ethnographic research on past and present epidemics in western Kenya, we assemble here some preliminary observations on the first weeks of COVID-19 in Kenya. We explore how the acute epidemic crisis currently unfolding is intertwined with layered fragments of earlier epidemic events, attending to material infrastructures, institutional practices, and ritual responses, to the presence of virally loaded bodies, pharmaceuticals, and their residues, and to the resurgence of often painful memories and emotions. People in this region have experienced a long century of epidemics and anti-epidemic measures of varying duration and intensity, from colonial and postcolonial sleeping sickness and smallpox to HIV/AIDS and more recently cancer, alongside actual or anticipated outbreaks of cholera and Ebola. This local perception of one long epidemic qualifies the notion of a radical temporal break that the COVID-19 pandemic is often associated with in European conversations. (shrink)

Equipoise is advocated as a means of achieving high scientific and ethical standards in randomised trials. As used in the context of research the word describes a state of uncertainty characterised by the belief that in a trial no arm is known to offer greater harm or benefit than any other arm. Clinicians who lack personal equipoise are advised to accept clinical or communal equipoise, based on current unresolved disagreement among the medical profession. Equipoise is mainly discussed in the literature (...) as an issue for senior doctors and research directors. Limitations of professional equipoise are reviewed, and data on the neglected topic of patients' equipoise are reported using the example of breast cancer trials. In theory, a patient who gives informed and voluntary consent to enter a randomised trial has achieved the equilibrium of equipoise. In practice, equipoise among patients ranges from personal to proxy acceptance. (shrink)

This article will examine McCormick's moral epistemology both at the level of how human persons know values and disvalues, which hereinafter will be referred to as synderesis, and at the level of how human persons know the rightness and wrongness of an action, which hereinafter will be referred to as normative moral judgment. On the one hand, from this investigation it appears that McCormick operates with a dual moral epistemology, at least at the level of synderesis. This means that at (...) one point in time it appears that a significant shift may have occurred in his moral epistemology at the level of synderesis. This may also be true at the level of normative moral judgment. On the other hand, McCormick's moral epistemology may in fact be a synthesis, which is the product of development and maturity in his thought process. This article will articulate, examine, and analyse both moral epistemologies. The first moral epistemology is operative in McCormick's writing up until 1983. The second moral epistemology corresponds to McCormick's decision in 1983 to write primarily in the area of bioethics from a theological perspective. Since the year 1983 seems to be the pivotal time when these two moral epistemologies converge, I will refer to the first moral epistemology as “prior to 1983” and I will refer to the second moral epistemology as “after 1983.” Because of the numerous criticisms that surround McCormick's moral epistemology, and the ambiguity that it entails, McCormick needed to articulate his theoretical foundations clearly and develop them systematically and coherently. Numerous moral theologians called for him to do this, yet he never responded. A systematic understanding of McCormick's moral epistemology is not only necessary but crucial in examining various issues in bioethics. It is necessary because it is the basis of moral decision making. It is crucial because the life and death of individuals may hang in the balance. (shrink)

The Nuremberg Trials of leading National Socialists established the principle that individuals may be legally punished, even by death, for obeying the laws of their country. Is there then a higher law by which enacted valid positive laws may be judged, so that persons subject to such laws would be duty-bound to defy them? In recent years the theory of natural law has been revived by a number of philosophers and jurists, who however often disagree sharply among themselves about the (...) proper methods for defining and deriving natural law. Howard Kainz surveys the history of natural law from its foreshadowing in ancient Greece down to the most recent controversies. Context: This conceptual paper tries to tackle the advantages and the limitations that might arise from including second-order science into global climate change sciences, a research area that traditionally focuses on first-order approaches and that is currently attracting a lot of media and public attention. Problem: The high profile of climate change research seems to provoke a certain dilemma for scientists: despite the slowly increasing realization within the sciences that our knowledge is temporary, tentative, uncertain, and far from stable, the (...) public expectations towards science and scientific knowledge are still the opposite: that scientific results should prove to be objective, reliable, and authoritative. As a way to handle the uncertainty, scientists tend to produce “varieties of scenarios” instead of clear statements, as well as reports that articulate different scientific opinions about the causes and dynamics of change for this specific field of research. As the United States is currently prosecuting two wars, it is important to consider whether those wars, and the resulting noncombatantcasualties, can be morally justified. Such consideration can be initiated by considering some of Alan Donagan’s work in his book The Theory of Morality. In that book Donagan sets out to develop, as a philosophical system, that part of the common morality according to the Hebrew-Christian tradition, which does not depend on any theistic beliefs. According to that tradition it is (...) sometimes morally permissible to resort to war. This poses a problem because also part of the tradition is a near absolute prohibition on harming innocent people. Since innocent people die in war, there is a tension here.Donagan claims that this problem can be solved by assigning the blame for some such deaths to the aggressor, thereby permitting (some) resorts to war. This paper shows that this solution is inadequate; and defends a more plausible (and more traditional) justification for some innocent deaths. This justification is consistent with the system Donagan develops, and thus may have application in the consideration of the justification of the two wars currently being prosecuted by the United States. The article is concerned with the question of how legal institutions are structured with the use of constitutive, institutive, consequential, and terminative rules. To that end, the regulation of international treaties as laid down in the Vienna Convention on the Law of Treaties of 1969 is analysed. This leads to the discovery of two additional categories of rules: content rules and invalidating rules. Finally, the special status of unique legal institutions is investigated. Unique legal institutions – for example, heads of (...) state, parliaments, and supreme courts – enjoy validity in a legal system to the exclusion of the validity of any other legal institution of the same category in that system.
